This Privacy Policy explains how Moxie Wellness (“Moxie Wellness,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit moxie-wellness.com (the “Site”), contact us, request or schedule a consultation, or receive telehealth services from us.
Moxie Wellness is a telehealth practice that provides cash-pay clinical services to patients located in the jurisdictions listed below. Please read this policy carefully. By using the Site or our services, you acknowledge the practices described here.
1. Jurisdictions we serve
Moxie Wellness provides telehealth services only to patients who are physically located, at the time of the visit, in a jurisdiction where our provider holds an active license. We currently serve patients located in:
- Florida
- District of Columbia
We verify each patient’s physical location at the start of every visit. We do not provide clinical services to any individual located outside the jurisdictions in which our provider is licensed, and we will not establish or continue a visit with a patient whose location cannot be confirmed within a state we serve. The jurisdictions in which our services are available are disclosed on the Site.
2. How this policy relates to HIPAA and your health records
Moxie Wellness is a covered entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). The way we use and disclose your Protected Health Information (“PHI”) — the individually identifiable health information created or received in the course of providing you care — is governed primarily by HIPAA and by our separate Notice of Privacy Practices (“NPP”).
- This Privacy Policy governs information collected through the Site and through general business interactions (for example, website forms, scheduling, email, and text communications).
- The Notice of Privacy Practices governs your PHI as a patient and describes your rights with respect to that information.
Where this Privacy Policy and the Notice of Privacy Practices both address the same information, the Notice of Privacy Practices controls for PHI. You can view our Notice of Privacy Practices at moxie-wellness.com/notice-of-privacy-practices, and we provide it to patients at or before the start of care.
3. Information we collect
a. Information you provide directly. When you contact us, request information, schedule a consultation, or become a patient, we may collect your name, email address, telephone number, mailing or billing address, date of birth, payment information, and the health and clinical information you choose to share with us in order to receive care.
b. Information from scheduling, communication, and intake tools. We use third-party platforms to schedule appointments, communicate securely, and accept payment. Information you submit through these tools (for example, booking details or messages) is collected by us and by those providers acting on our behalf.
c. Information from listing and referral platforms. If you reach us through a healthcare directory or referral platform, we may receive the contact and request information you submitted on that platform.
Like most websites, the Site and the third-party tools we use may automatically collect limited technical information — such as IP addresses, browser type, and device information — through our hosting provider’s server logs and first-party site statistics, and through embedded service providers such as our scheduling and form tools. We use this information to operate and secure the Site and to understand general usage, not for advertising or to track you across other websites (see Section 6).
4. How we use information
We use the information we collect to:
- respond to your inquiries and provide the information or services you request;
- schedule, deliver, document, and follow up on telehealth services;
- process payment for services;
- communicate with you about your care, appointments, and our services;
- operate, maintain, and secure the Site and our services;
- comply with our legal, regulatory, professional, and licensing obligations; and
- detect, prevent, and respond to fraud, security incidents, and misuse.
We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising. We do not run advertising, remarketing, or cross-site tracking technologies on the Site (see Section 6), and we do not use or disclose your Protected Health Information for marketing or advertising.
5. How we disclose information
We disclose information only as described in this policy or, for PHI, as permitted by HIPAA and described in our Notice of Privacy Practices. We may disclose information:
a. To service providers and business associates. We work with vendors who perform functions on our behalf — for example, appointment scheduling, secure patient communication, payment processing, email and practice communications, and technical hosting. Vendors that handle PHI do so under written Business Associate Agreements that require them to safeguard that information and use it only for permitted purposes.
b. As required or permitted by law. We may disclose information to comply with applicable laws, regulations, legal process, or enforceable governmental requests, and to protect the rights, safety, and property of our patients, our practice, or others.
c. In connection with a business transition. If our practice is involved in a merger, acquisition, or transfer of assets, information may be transferred as part of that transaction, subject to applicable law and the protections of this policy and HIPAA.
We do not disclose your information to third parties for their own independent marketing purposes.
6. Cookies and tracking technologies
The Site uses a limited set of cookies and similar technologies to operate, secure, and understand general use of the Site. These include cookies set by our hosting and content-delivery provider (WordPress.com / Automattic) and its first-party site statistics, and Google reCAPTCHA, which helps protect our forms from spam and abuse (reCAPTCHA is a security service and is not used for advertising).
We do not run Google Analytics, the Meta (Facebook) pixel, or any third-party advertising, remarketing, or cross-site behavioral-tracking technologies on the Site, and we do not track your activity across other websites for targeted advertising.
We use certain third-party services to provide specific functions you request — for example, ZocDoc for appointment scheduling and Kit for email sign-up forms. When you use those features, the applicable provider collects the information you submit under its own privacy policy.
You can control cookies through your browser settings; disabling certain cookies may affect Site functionality. If we add any analytics or advertising technologies in the future, we will update this policy and provide any notice or choices required by law before they are activated.
7. How we protect information
We maintain administrative, technical, and physical safeguards designed to protect your information. Information regarding transactions, patients, payments, medical information, and other sensitive or confidential information transmitted through the Site is processed using Secure Socket Layer (SSL) / Transport Layer Security (TLS) encryption. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we work to protect your information consistent with applicable law and professional standards.
8. Where your information is processed
We are a telehealth practice that operates on a location-independent basis. Your information is stored on systems located in the United States and is accessed only by authorized personnel for the purposes described in this policy, who may access it from inside or outside the United States. Wherever your information is accessed, it remains subject to this policy, our Notice of Privacy Practices, applicable U.S. and state law, and the safeguards required by our agreements with our service providers.
9. Data retention
We retain personal information and health records for as long as necessary to provide services, to comply with our legal, regulatory, professional, and recordkeeping obligations (including state medical-records retention requirements), to resolve disputes, and to enforce our agreements. Retention periods for medical records are governed by the laws of the state in which care was provided.
10. Your privacy rights
General
You may contact us at any time using the details in Section 14 to ask about the information we hold about you or to update your contact information. Rights regarding your PHI — including the rights to access, amend, and receive an accounting of disclosures of your health records — are described in our Notice of Privacy Practices and are governed by HIPAA and applicable state law.
Reproductive and sexual health information
Some of the services we provide may involve information relating to reproductive or sexual health. We treat this information as sensitive. When such information is part of your care, it is PHI protected under HIPAA and our Notice of Privacy Practices, and it is not used or disclosed for marketing or advertising purposes.
State-specific rights
For residents of states with applicable privacy or medical-confidentiality laws, we honor the rights and protections those laws provide. Contact us using the details in Section 14 to exercise any rights available to you.
11. Children’s privacy
The Site and our services are intended for adults. We do not knowingly collect personal information from children except in the context of providing care to a minor patient with the involvement and authorization of a parent or legal guardian as required by law. If you believe a child has provided us information through the Site without authorization, please contact us so we can address it.
12. Third-party websites and platforms
The Site and our communications may contain links to, or be reachable through, third-party websites and platforms, including healthcare directories and scheduling or referral services. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party site or platform you use.
13. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and post the current version on the Site. Material changes will be communicated as required by applicable law. Your continued use of the Site after an update takes effect indicates your acknowledgment of the revised policy.
